The offer and sale of products on our website ("www.bestwind.it") are governed by these Terms and Conditions of Sale. Products purchased on www.bestwind.it are sold directly by BestWind SRL. BestWind is registered with the Chamber of Commerce, Industry, Handicrafts, and Agriculture of Verona, VAT number IT 04762880237. BestWind's headquarters are located in Italy, at Via Gardesana, 294 - 37018 Malcesine (Verona). You can request any information from BestWind via the contact page, directly by calling us at +39 045-7400075, or by sending an email to sail@bestwind.it. BestWind offers products for sale through the website www.bestwind.it and carries out its e-commerce activities targeting end users who are either "consumers" or commercial businesses. These Terms and Conditions of Sale exclusively regulate the offer, transmission, and acceptance of purchase orders for products on www.bestwind.it. Your order will be stored in our database for the period of time required to process orders and, in any case, in accordance with legal terms. The language available to conclude the contract is Italian. BestWind reserves the right not to process purchase orders if there are insufficient guarantees of solvency, if orders are incomplete or incorrect, or in the event of product unavailability. In such cases, we will inform you via email that the contract has not been concluded and that BestWind has not proceeded with your purchase order, specifying the reasons.

PLEASE NOTE THAT DURING AUGUST AND HOLIDAY SEASONS (CHRISTMAS, EASTER, ETC.), WE CANNOT GUARANTEE REGULAR SHIPPING SERVICES NOR THE FULL AND IMMEDIATE AVAILABILITY OF ITEMS DUE TO THE CLOSURE OF COMPANIES AND OUR SUPPLIERS.

Purchase Contract

To conclude the purchase contract for one or more products on bestwind.it, a minimum order value of 30 euros (VAT included) is required, excluding shipping costs.

You must fill out the order form with all the required information, accept the terms and conditions, and submit the order, following the guided procedure on the website.

Before confirming and sending the order, you will be presented with a summary of the selected items, including a description of each product, quantity, and its relative price, your selected payment method, the delivery methods for the purchased products, the shipping costs to your specified address, and the Terms and Conditions of Sale.

Once the order is sent, you will receive an automatic email confirming receipt of the order by BestWind, featuring a summary containing: name, quantity, color, and price of the items; payment method; and shipping costs to the address provided. This email does not automatically confirm the availability of all your selected items. If no further communications are needed, you will receive an email as soon as the courier collects your parcel from our store.

Otherwise, if any items are unavailable, you will be notified as soon as possible (and within our stores' opening hours).

Once the order form is confirmed and submitted, you:

• unconditionally accept the terms and conditions described on this page;

• unconditionally confirm the correctness of the shipping and billing data and address provided in the order form;

• unconditionally confirm your intention to purchase the selected items and acknowledge that you are fully aware of their features, color, size, fit, dimensions, and quality;

Should the products displayed on bestwind.it become unavailable after the customer has submitted the order form, BestWind will promptly inform you (via the email address or phone number provided at checkout) of the unavailability of the ordered products. We will offer a valid alternative or a refund for the unavailable items if the proposed alternative does not meet your needs. Refunds will be issued via bank transfer and will equal the amount stated in the order form for that specific item (in the case of a partial refund) or the total amount paid (in the case of a full order cancellation).

If you choose to accept an alternative to the unavailable product, you will be refunded the price difference (if the new item costs less than the one already paid for) or you will be requested to pay the difference (if the new item costs more than the previously purchased one).

The contract is concluded when BestWind receives your order, confirms product availability, and ships the items you purchased.

The order form will be stored in our database for the period of time required to process orders and, in any case, within the terms provided by law.

You can access your order form by consulting the "order history and details" section in your personal account, where you can also view the progress of your order.

If you do not agree with any of the terms outlined in the Terms and Conditions of Sale, please do not submit the order form.

Guarantees and Product Price Indication

On bestwind.it, clothing, technical equipment, and accessories from various brands related to the world of sailing, windsurfing, and boating are offered for sale.

Each product has been carefully selected and purchased by BestWind from authorized distributors, manufacturers, and retailers.

Items not explicitly marked as "USED" (such as certain sails, boards, booms, masts, or boats) are brand new, unused, and intact.

Product features are described on bestwind.it within each product page through descriptions and images. The desired color and size must be specified by selecting them from the product page dropdown menu. However, colors might not correspond exactly to the real ones due to monitor settings or photographic rendering.

Product prices may be subject to updates. Please verify the final sale price before submitting the relative order form.

In the event that you exercise your right of withdrawal, BestWind reserves the right to reject the return of items that lack proof of purchase (receipt), original packaging, labels, and seals present at the time of shipping, or items that have been altered or damaged.

Payments

You can select your preferred payment method before submitting your order form.

The total price will include shipping costs, which are calculated based on the weight of the parcel and your specified delivery address.

STRIPE

In case of payment by credit card, all payment details (credit/debit card number, expiration date, cardholder name) will be securely processed through the STRIPE network, a company providing remote electronic payment services, without any third party being able to access them in any way.

PAYPAL

In case of payment via PayPal, the user will be redirected to the secure PayPal system, where they can complete the payment simply by using their PayPal account credentials.

SCALAPAY

In case of payment via Scalapay, the user receives the order immediately and pays in 3 installments. The user acknowledges that the installments will be assigned to Incremento SPV S.r.l., to related parties, and their assignees, and authorizes this assignment.

Order Processing Times

BestWind is committed to processing every order as quickly as possible.

Normally, for orders containing items currently in stock received before 10:30 AM, every effort will be made to dispatch them on the same day (if a working day) or on the following working day if the order was received on a holiday.

Orders received after 10:30 AM, or on holidays and days preceding holidays, will be processed on the following (working) day.

Should one or more items be temporarily unavailable, you will be notified via email during the day.

For orders paid via BANK TRANSFER, processing times begin from the moment BestWind receives proof of payment. To speed up the process, please send a copy of the bank transfer receipt to ordini@bestwind.it, quoting your order number.

If you do not receive a prompt reply or order confirmation, please take into account the operating hours of our online sales department: Mon-Fri 9:30 AM - 1:00 PM. However, our physical store is open every day from 9:30 AM to 8:00 PM (including Sundays and holidays); for any questions or advice, do not hesitate to contact us.

For inquiries regarding orders already in progress, please communicate directly with our online sales manager, available every morning from Monday to Friday, 9:30 AM - 1:00 PM.

Right of Withdrawal - RETURNS

You have the right to withdraw from the contract concluded with BestWind, without any penalty, within 14 working days from the day you receive the products purchased on bestwind.it.

Returned products must reach one of our stores no later than 30 working days from the date you received them.

The only costs you will incur are the shipping fees for returning the purchased products.

The Right of Withdrawal is considered properly exercised if the following conditions are also fully met:

  • products must be returned intact, without being used, worn, or damaged;
  • products must be returned in their original packaging, complete with all their elements and accessories, accompanied by instructions/notes/manuals, original boxes and wrappers, the warranty certificate where present, with original tags unremoved, and the relative proof of purchase (receipt);
  • products must arrive at our store INTACT in undamaged packaging. It is the customer's responsibility to ensure that items are packed in packaging suitable for transport that will not fall apart, causing loss or damage to the items themselves.

BestWind reserves the right to reject visibly damaged parcels and disclaims all liability for any loss or damage to items during transport. No refund will be issued by BestWind for items lost due to inadequate packaging.

We will initiate the refund procedures once the returned items are received and verified for compliance with the terms and conditions outlined above. The amounts will be refunded as quickly as possible and, in any case, within thirty days from your withdrawal request. The refunded sum is net of the shipping costs paid for the delivery of the purchased products.

If the terms and conditions for exercising your right of withdrawal are not respected as specified above, you will not be entitled to a refund; however, you may reclaim the products at your own expense in the condition they were returned to us. Otherwise, BestWind may retain the products in addition to the amounts already paid for their purchase.

BestWind will also refund the delivery shipping costs (in addition to the product value) only if the return is due to causes attributable to BestWind—for example, if the products do not possess the essential promised characteristics (such as a different color or size from those ordered) or present manufacturing defects.

In any case, these causes must first be verified by BestWind once the returned items are received. Only following this verification will you be refunded both the shipping costs and the cost of the returned item via the payment method used at checkout.

How to Request a Return or Exchange

To proceed with a return or a refund request, please first ensure that your request meets the terms and conditions described above. You can then contact us to communicate your request (by phone or via email at ordini@bestwind.it). We will then send you the return/withdrawal form via email with all instructions, terms, and conditions, which you must fill out and send back to the same email address.

Refund Times and Methods

Following the return of the products, BestWind carries out the necessary checks regarding their compliance with the conditions and terms indicated in the section above. If the checks are successful, we will send you a confirmation of acceptance of the returned products via email.

The refund will be issued via the same payment method used for the purchase: credit cards, PayPal, or bank transfer. If the purchase was made using a gift card, the refund will be issued as a gift card/store credit and not via credit card or cash. The refund process will be activated within thirty days from the date BestWind became aware of your withdrawal request, subject to verification of the correct execution of your right of withdrawal and acceptance of the returned products.

Shipping costs for the return will be at your expense (see the "right of withdrawal" section), including liability in case of loss or damage to the products.

Applicable Law

These Terms and Conditions of Sale are governed by Italian law, specifically by Legislative Decree no. 185 of May 22, 1999, concerning distance contracts, and Legislative Decree no. 70 of April 9, 2003, concerning certain aspects of electronic commerce.

Amendments and Updates

The Terms and Conditions of Sale are amended from time to time, also in consideration of potential regulatory changes.

The new Terms and Conditions of Sale will be effective from the date of publication on www.bestwind.it
